Landowner Representation

Nacelle represents landowners on renewable energy and infrastructure projects. We review and negotiate leases, easements, options, purchase agreements, and related documents, including what the landowner will be paid, how the property can be used, and what each party must do during the term of the agreement.

Our experience with project development and financing helps us understand what landowners, developers, and lenders need from these agreements. We use that experience to help landowners understand proposed agreements and negotiate terms that work for their property and the project.

How We Help

  • Reviewing and negotiating rent, royalties, payment increases, and other compensation.
  • Reviewing how long the agreement lasts and when either party can extend or end the agreement.
  • Agreeing on how the developer can use the property, where facilities and roads can go, and which areas remain available for the landowner’s use.
  • Addressing farming, ranching, timber, hunting, mineral rights, water use, and other existing or planned uses.
  • Negotiating responsibility for property damage, taxes, insurance, and claims arising from project activities.
  • Reviewing who can take over the agreement, what rights project lenders have, and what the landowner must do when a project is sold or financed.
  • Negotiating equipment removal, restoring the land, and obligations during restoration.
  • Reviewing proposed amendments, requests for approval, and documents the landowner is asked to sign after the original agreement.

Agreements That Account for the Property’s Future

A project agreement can affect a property for decades. We work with landowners to understand how they use the property, what they want to preserve, and whether they expect to develop it in the future.

We consider how payments and property rights may change while the project is being planned, built, and operated. We also address changes in project acreage, timing, and ownership, and what happens when the agreement ends, including facility removal and property restoration. We help put the parties’ agreement on those matters in writing.
